(BISMARCK) – An out-of-state attorney has been barred from practicing law in North Dakota. According to a ruling by the North Dakota Supreme Court, Mark Daniel is, in addition to being disbarred, ordered to pay for the disciplinary proceedings as well as restitution.
The Court says Daniel practiced law in Houston, Texas, and was admitted to practice law in North Dakota in September 2020.
The disbarment stems from a hearing panel conclusion that “Daniel’s conduct violated Ind. R. Prof’l Cond. 1.8, Conflict of Interest: Current Clients: Specific Rules, by failing to appropriately counsel his client as to a potential conflict of interest by way of his involvement and guarantee of the loan issued to them by a third party,” the Court’s ruling said.
He is not allowed to be reinstated for at least five years.
