SHAKOPEE, Minn. – A hearing on the election contest of a Shakopee area Legislative race is set to be heard Monday.
The House GOP and Republican Aaron Paul filed a lawsuit contesting the results of DFL Representative Brad Tabke’s election win.
The suit alleges Scott County election officials engaged in deliberate, serious and material violations of state election law when they lost 21 ballots in the House 54A race. The county says the ballots were likely thrown away and won’t be recovered.
Tabke won the election by 14 votes.
Republicans ask the judge to declare a vacancy for Tabke’s seat once his current term ends.
The Minnesota House is tied at 67 seats apiece for DFLers and Republicans.
