Charges for inmate accused of beating another man

JAMESTOWN, N.D. (Valley News Live) – An inmate at the James River Correctional Center in Jamestown is facing additional charges after officers say he assaulted another inmate.

Valley News Live’s Gretchen Hjelmstad reports Benjamin Joseph Capistran is charged with aggravated assault and possession of weapon by an inmate.

According to court records, Capistran put a tablet inside a mesh bag and hit another inmate over the head. That man fell to the floor and tried to protect his head using his arms.

Capistrain is accused of continuing to beat him while he was on the ground.

The victim was taken to the emergency room where he was treated for multiple fractures to his face and skull.

“Prior to the assault, Capistran was seen standing in the corner of the dorm with a blank stare,” court records state. The officer reports that several of the inmates asked Capistran if he was okay, and he said he was fine.
