BISMARCK. N.D. – The North Dakota Supreme Court says the City of Fargo does not have the authority to ban people from selling guns out of their homes.
The high court upheld a lower court’s decision to dismiss a lawsuit brought by Fargo against state lawmakers.
The city’s lawsuit would have blocked a bill prohibiting cities from banning gun sales in homes.
The state Supreme Court says the legislature has the right to create and define powers for home rule cities, and Fargo’s argument that it has the power to make laws to protect people is misplaced.
