Arizona DAPL protestor’s lawsuit dismissed after accusations of excessive force

BISMARCK, ND — A federal North Dakota judge has dismissed the rest of a lawsuit filed by an Arizona man who claimed he was a victim of excessive force by police while protesting the Dakota Access oil pipeline.

Marcus Mitchell sued several law enforcement officers and the city of Bismarck and Morton County, claiming officers targeted him during the 2017 protests when they fired a bean bag round at his eye. His lawsuit also alleged that his constitutional rights were violated.

The case was dismissed, reinstated after an appeal, and has just been dismissed once again.
